I'm not here to drum up business for lawyers, but I cannot stress firmly enough the need for prenuptial agreements before you say, "I do."
Without a "blueprint" outlining who gets what, your divorce proceeding distribution of assets will have to follow the laws of your state.
In most states that means a judge will be able to divide those assets in a way he or she believes is fair if you and your ex are unable to.
But in the 9 community property states all assets acquired during the marriage will be split 50/50 with no consideration of the financial condition of each party.
In most states any assets brought into the marriage remain yours in divorce, but you would have to provide proof of ownership if your soon-to-be ex wants to make trouble.
A prenuptial, properly drafted, can save you from all this trouble in case your marriage hits the rocks.
